Attorney Brian Webb of Brian Webb Legal Argues Case Before Idaho State Supreme Court

On November 7th, 2014th two parties entered into a real estate lease agreement for 14 mobile home lots on 1.96 acres of land in Nampa, ID. The lease agreement was contingent on signing an option to purchase. The lease agreement and option to purchase were exercised by the purchasing party, and on Nov 15th, 2014, the seller turned over possession of the property to the buyer.

A new property manager arrived on site, and mobile home tenants were given new rental agreements, and instructed to make rental payments to the new owner. Shortly after, tenants received notice from the previous owner that they should continue to make payment to them, not to the new owner. A lawsuit ensued at that point after the seller allegedly discovered the transaction was not what she anticipated.

When the case went to District Court, the Judge ruled that due to an incomplete legal description of the property on the lease agreement and option, the contracts were invalid and void. In an appeal that reached the Idaho Supreme Court, Attorney Brian Webb argued in front of Idaho’s five Supreme Court Justices, on behalf of the buyer, that the option and lease agreement did in fact contain a full detailed legal description of the property because, among other things, the two documents referenced each other. His position was that the agreements were therefore valid.

Attorney Brian Webb made the following comment after presenting his arguments to the Idaho Supreme Court. “A decision from the Idaho Supreme Court on these issue could provide additional guidance and clarification to real estate lawyers and agents on the requirements necessary to create valid contracts of lease and options to purchase real estate.”
